No.

Partner cannot act over 1, so either he holds hearts and trap passed or he is just too weak to bid.

I'm not going to let them find the superior contract now, it might be game for them.

I agree. Partner cannot act. Therefore the opposition has probably at least a 9-card spade fit between them. I think it is better to pass.
